SC mandates Karnataka, TN to revisit quota laws

The Supreme Court of India has mandated the states of Karnataka and Tamil Nadu to revisit the quota laws which provide quota in excess of 50% in jobs and education, and thereby disposed off the petitions challenging the Acts that allowed 69% and 73% reservation of backward classes, scheduled castes, scheduled tribes and other backward classes in educational institutions and appointment in government services TN and Karnataka, respectively. The court, however, stated that in case of Tamil Nadu, the parameters laid down by the Mandal Commission – formed in 1979 to identify socially and economically backward classes – will also be taken into consideration while revisiting the quota laws. Meanwhile, the court also extended the interim orders of the Apex Court allowing 69% reservation in Tamil Nadu for a period of one year.

The Karnataka Government, on the other hand, has been restrained to exceed 50% quota limit and asked to re-examine the laws in light of fresh data and in accordance with the Mandal Commission if it wants to provide reservation beyond the limit.
